descriptionTwo 1999 Santa Cruz decisions in ejecuciones prendarias brought by the same car dealer. A municipality appeared with a boleta de deuda and asked the court to retain part of the money obtained at the subasta of the pledged goods, invoking the privilege of art. 43 inc. 2 of the prenda con registro law. The Cámara refused: the boleta lacked the procedural requisites and the debtor had not been heard. The Tribunal Superior later held that such a claim of retention and preference, raised in a prendaria execution, must be processed as an incident within the special concurso the execution opens.
