descriptionSanta Fe's Corte Suprema, 18 August 2004 (Gutiérrez, Gastaldi, Netri, Spuler). A bank had a pledged car seized under art. 39 Ley 12.962 and sold it privately; the debtor sought nullity of the seizure, invoking the 180-day suspension of executions in art. 16 of emergency Ley 25.563 and the absence of the edict required by Código de Comercio art. 585. The Cámara upheld the seizure and the Corte rejected the debtor's queja: art. 39 is a narrow procedure that only obtains the seizure, the emergency law at most allowed asking for a suspension on proof, and disagreement is not arbitrariness.
