Under PBA CPCC art. 573 the ejecutado may free the auctioned property until the buyer pays the saldo de precio — judicial approval of the auction is irrelevant; after that payment nothing frees it without the buyer's consent, and a deposit that fell short cannot be completed later. The seña to be refunded is the gross seña, including expenses the martillero deducted.
