Argentina (AR) — civil law.

Nothing on this page describes United States practice. There is no certificate sold to an investor, no administrative sale of land for unpaid tax, and no redemption window after a subasta judicial in Argentina. If you arrived carrying US assumptions, read falsos-amigos first.

Hipoteca abierta and de máximo — securing undetermined credits

A classical hipoteca secures one identified debt. Argentine practice has long wanted something looser — a mortgage over a borrower’s property securing whatever a bank lends him over the next years, a supplier’s running account, a construction line. The 2015 code admitted this hipoteca de máximo (colloquially hipoteca abierta) through the principle of especialidad en cuanto al crédito, and the 2016 UVA law retouched the rule. For an auction, the point is simple: the cap in the escritura, not the balance the creditor claims, is the outer limit of what he collects with privilege.

The opening section is open to everyone. The procedure in detail — statutes, deadlines, who may bid, and what the record does not say — is behind a free account.

We ask for one because writing these from primary sources is slow work, and knowing who relies on it tells us which country to do next.
