Argentina (AR) — civil law.

Nothing on this page describes United States practice. There is no certificate sold to an investor, no administrative sale of land for unpaid tax, and no redemption window after a subasta judicial in Argentina. If you arrived carrying US assumptions, read falsos-amigos first.

Redargución de falsedad and nulidad de escritura — attacking the public instrument

Argentine real-property law runs on the instrumento público — the escritura authorised by an escribano, the acta of a court officer, the judicial testimonio. A separate family of attacks says the instrument is void for form. Both matter at auction because the hipoteca being executed exists only in an escritura (CCyC 2208), and because the buyer’s own title will rest on judicial instruments of the same class.
