Argentina (AR) — civil law.

Nothing on this page describes United States practice. There is no certificate sold to an investor, no administrative sale of land for unpaid tax, and no redemption window after a subasta judicial in Argentina. If you arrived carrying US assumptions, read falsos-amigos first.

Auto de aprobación del remate — the order that validates the sale

The fall of the hammer does not transfer anything in Argentina. The martillero reports the result to the court, the court checks it, and only the auto de aprobación del remate (also auto aprobatorio de la subasta) gives the sale legal effect. Three deadlines are keyed to it: the buyer’s payment of the saldo, the end of the debtor’s sobreseimiento window, and — upstream — the 5-day window to seek nullity. It is also the document the Registro de la Propiedad ultimately receives in place of an escritura.

The opening section is open to everyone. The procedure in detail — statutes, deadlines, who may bid, and what the record does not say — is behind a free account.

We ask for one because writing these from primary sources is slow work, and knowing who relies on it tells us which country to do next.
