Argentina (AR) — civil law.

Nothing on this page describes United States practice. There is no certificate sold to an investor, no administrative sale of land for unpaid tax, and no redemption window after a subasta judicial in Argentina. If you arrived carrying US assumptions, read falsos-amigos first.

Decreto-Ley 6582/58 — Régimen Jurídico del Automotor

The Régimen Jurídico del Automotor (RJA) is national law — one statute for the whole country, unlike procedure. It makes registration constitutive: a transfer of a vehicle “solo producirá efectos entre las partes y con relación a terceros desde la fecha de su inscripción” in the Registro Nacional de la Propiedad del Automotor (art. 1). Whoever buys a vehicle at a `subasta judicial` therefore does not own it — against anyone — until the court’s order has been inscribed at the DNRPA Registro Seccional. The same statute covers motorcycles, trailers and every self-propelled agricultural, road and industrial machine (art. 5).

The text in force is the texto ordenado of Decreto 1114/97, amended by Leyes 25.232, 25.345, 25.677, 26.348 and 27.187 and — heavily — by DNU 70/2023, Title XVI (arts. 351–364), which digitised the título and cédula, opened a remote national filing channel, abolished the territorial radicación articles, and provided that unpaid patentes or fines “en situación regular” cannot block a transfer. For a buyer at a forced sale, five provisions do most of the work: art. 1 (constitutive inscription), arts. 2–4 (good faith and stolen vehicles), art. 14 (inscription of a judicially-ordered transfer), art. 16–17 (priority and the lifespan of embargos and inhibiciones) and art. 27 (liability, denuncia de venta and pedido de secuestro).

The opening section is open to everyone. The procedure in detail — statutes, deadlines, who may bid, and what the record does not say — is behind a free account.

We ask for one because writing these from primary sources is slow work, and knowing who relies on it tells us which country to do next.
