Argentina (AR) — civil law.

Nothing on this page describes United States practice. There is no certificate sold to an investor, no administrative sale of land for unpaid tax, and no redemption window after a subasta judicial in Argentina. If you arrived carrying US assumptions, read falsos-amigos first.

Cesión del crédito hipotecario — transferring the secured loan and its hipoteca

Non-performing mortgage loans change hands in Argentina as everywhere: a bank sells a portfolio, a fideicomiso buys defaulted credits, an investor buys the one loan whose execution is already under way. The legal form is the cesión de derechos of CCyC arts. 1614–1631, and the hipoteca follows the credit automatically because it is accessory. The auction-relevant questions are who may sue, when the transfer binds the debtor and the registry, and what defences survive it.
