Argentina (AR) — civil law.
Nothing on this page describes United States practice. There is no certificate sold to an investor, no administrative sale of land for unpaid tax, and no redemption window after a
subasta judicialin Argentina. If you arrived carrying US assumptions, read falsos-amigos first.
Honorarios of the abogado and the martillero — who is paid what from the sale
Two professionals are paid out of an Argentine judicial auction before anyone else sees
the money: the abogado of the executing creditor (and of any other party awarded
costs), and the martillero who conducted the sale. The abogado’s fee is regulated
by the court under an arancel; the martillero’s comisión is a customary or
statutory percentage, typically paid by the buyer at the hammer. Both have a privileged
seat in the distribution: CCyC art. 2585 reserves from the price, before even the
hypothec creditor is paid, the costs of “conservación, custodia, administración y
realización” and “los gastos y los honorarios generados por las diligencias y
tramitaciones llevadas a cabo sobre el bien”.

The opening section is open to everyone. The procedure in detail — statutes, deadlines, who may bid, and what the record does not say — is behind a free account.
We ask for one because writing these from primary sources is slow work, and knowing who relies on it tells us which country to do next.
